AI Calling Agents in Real Estate: TRAI's New Rules Explained

TRAI's September 2026 rules treat AI calling agents as automated 'A2P' calls: a broker must declare them to its telecom operator in advance, or each call counts as spam. Calls on a buyer's enquiry are allowed only within seven days. The declaration rule starts 60 days after the rules are gazetted.

If you buy property leads and an AI voice agent now rings them back within a minute, the rules for that call changed on 18 September 2026. That day the Telecom Regulatory Authority of India (TRAI) amended its anti-spam regulations, and an AI calling agent is now squarely inside them.

This guide explains what the TCCCPR (Third Amendment) Regulations, 2026 mean for brokers, channel partners and developers who use AI callers, what it costs to run one, and what buyers can expect. It is a plain-English summary of TRAI's text, read on 3 November 2026, not legal advice.

What TRAI changed for AI calling agents

TRAI created a new category, the "A2P call", and defined it as "a voice call that is initiated by an application, software system, or automated platform without direct human dialling", including calls made with "autodialling, robo-calls and/or pre-recorded/artificial voice technologies". An AI agent that dials a lead and talks to them is exactly that.

Two consequences follow:

  • Declare before you dial. "Every Sender shall declare to the Originating Access Provider (OAP), in advance, about the use of Application-to-Person (A2P) calls", along with the calling-number ranges it will use. The access provider is your telecom operator.
  • Undeclared means spam. An A2P call made without that declaration "shall be treated as Unsolicited commercial communication", the regulation's term for spam, with the penalties that come with it.

TRAI also lets operators charge up to "Rs. 0.05 (five paisa only) per minute" to deliver A2P calls, except calls from the 140xx, 1600xx and 1601xx series. TRAI has separately said promotional calls from any sector must use 140xx numbers, according to a July 2026 Tribune report of its clarification.

When the rules start

The amendment does not switch on all at once. Most of it applies 30 days after it is published in the Official Gazette; the A2P declaration, the five-paise charge and the header and template rules apply after 60 days; appeals and the new AI-assisted complaint checks after 90 days.

TRAI dated the notification 18 September 2026. We could not confirm the Gazette publication date, which starts the clock. If it was published that day, the A2P declaration would apply from about 17 November 2026. Until the date is confirmed, treat mid-November as the deadline and declare early.

The seven-day rule for calling a buyer's enquiry

This is the change that collides with how most brokers work. Under the amended rules, a commercial "relationship" that lets you contact someone because they enquired lasts only for communications "within seven days" of that enquiry. The enquiry "shall be made in writing or through digital means, and shall be maintained in a verifiable form by the Sender". A formal application, by contrast, keeps the relationship open for three months.

So the common practice of calling a portal lead for weeks is now risky after day seven, unless the buyer has given fresh consent. One question the regulation doesn't settle: whether a form filled on a property portal counts as an enquiry made to the broker who later buys that lead. If you rely on bought leads, ask the portal how it records consent, and keep your own record.

Real estate is a do-not-disturb category

TRAI's opt-out table lists "Real Estate" as promotional category 2. A buyer who has blocked that category on the do-not-disturb (DND) list shouldn't get your promotional calls, from a person or an AI.

TRAI's enforcement has teeth. Under the amended rules, if five or more of a sender's calling numbers are flagged within 10 days, the sender faces investigation, fresh KYC checks and barring, with disconnection for repeat cases. Three or more unique complaints within 10 days, plus a flag from the operators' AI and machine-learning checks, also triggers action. TRAI's press release says a telemarketer found at fault is disconnected across operators for a year and blacklisted.

What an AI calling agent costs

Few vendors publish prices, but Zappio, an Indian AI caller built for real estate, does. Its pricing page lists ₹7.00 a minute with no monthly fee, ₹5.00 a minute on a ₹2,999 monthly plan and ₹4.50 on a ₹5,999 plan, all plus 18% GST, as checked on 3 November 2026.

Plan Monthly fee Per minute A two-minute call, with GST (our calculation)
Pay As You Go ₹0 ₹7.00 ₹16.52
Starter ₹2,999 ₹5.00 ₹11.80
Growth ₹5,999 ₹4.50 ₹10.62

Note who carries the compliance. Zappio's privacy policy leaves do-not-disturb and TRAI duties with the customer, so the declaration to your operator is your job, not the software's. Opting out of calls is not the same as deleting your data

TRAI's explanatory memorandum uses a real estate example to separate two kinds of consent. "A person 'X' who wants to rent an accommodation may have provided her personal data to a real estate agent 'Y'," it says. If X withdraws permission under the telecom rules, "only her permission to receive information from Y through phone calls or SMS is withdrawn while the processing of her personal data by Y continues independently".

Removing her data altogether is a separate request under the Digital Personal Data Protection Act, 2023. Its rules were notified on 14 November 2025 with an 18-month phase-in, according to the government's backgrounder, and require a separate consent notice explaining the specific purpose of collecting data. If your AI caller records conversations, tell buyers why and for how long.

WhatsApp follow-ups have their own rules

Many AI callers hand the lead to WhatsApp afterwards. WhatsApp's Business Messaging Policy, last updated on 23 September 2026, lets you message people only if they gave you their number and "opt-in permission" for further messages, and you must honour opt-out requests made on or off WhatsApp. Automated replies are allowed, but you "must also have available prompt, clear, and direct escalation paths", such as a human agent. Outside the 24-hour reply window, only approved message templates may be sent.

A checklist before you switch on an AI caller

  1. Declare A2P calling to your telecom operator, with the numbers you will call from, before the 60-day date.
  2. Use the right number series for promotional calls (140xx, per TRAI's clarification).
  3. Call enquiries within seven days, and keep a record of when and how each buyer enquired.
  4. Respect DND category 2 (real estate) and every opt-out, on calls and on WhatsApp.
  5. Tell buyers it's an AI, and offer a person. TRAI's separate 2 November 2026 rules will require exactly this on telecom companies' own complaint lines once they apply, as we reported in our story on TRAI's AI-agent rules.
  6. Read your vendor's privacy policy for call recordings, AI training and processing outside India.

What it means for home buyers

The rules should mean fewer repeat calls about a flat you enquired about once. From the 60-day date, an AI agent ringing about a property should be calling from a declared number, and a broker calling more than seven days after your enquiry needs fresh consent. If you get unwanted calls, blocking real estate on the DND list and complaining through your operator now carries real consequences for the sender. If a caller's voice sounds like someone you know asking for money, that's a different problem: our AI voice scam guide explains how to check.

FAQ

Yes, but from about mid-November 2026 a business must declare its AI or automated (A2P) calls to its telecom operator in advance. TRAI's rules treat undeclared A2P calls as spam.

How long can a broker call me after I enquire about a property?

Seven days, under TRAI's September 2026 amendment, unless you give fresh consent. A formal application keeps the window open for three months.

Does DND stop AI calls from property brokers?

It should for promotional calls: TRAI lists real estate as category 2 on the do-not-disturb opt-out table, and the rules cover AI and automated calls as well as human ones.

How much does an AI calling agent cost for real estate in India?

Zappio, one Indian provider, charges ₹4.50 to ₹7.00 a minute plus 18% GST, so a two-minute call costs about ₹10.60 to ₹16.50 by our calculation. Most others quote on request.
